Affiliate Agreement

This Agreement contains the terms and conditions that apply to a participant in the PIM affiliate program (the "Program").

As used in this agreement, "we" means profitable Internet Marketing and "you" means the applicant, "site" refers to a World Wide Web site.

To begin the enrolment process, you will submit a complete Affiliate Application form.

We will evaluate your application in good faith and will notify you of your acceptance or rejection. We may reject your application if we determine (in our sole discretion) that your site is unsuitable for the Program. Unsuitable sites include, for example, sites that: promote sexually explicit materials promote violence promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age promote illegal activities or violate intellectual property rights.

We grant you a non-exclusive, revocable right to use our present banners and other such images for which we grant express permission, for the purpose of identifying your site as a program participant and linking to our site. You may not modify the banners or any of our images in any way without our express permission.

We reserve all of our rights to our trade names and trademarks and all other intellectual property rights. We reserve the right to revoke your affiliate status if it is shown that you are not acting in the Programs best interests. Affiliate status will be revoked immediately if it is demonstrated that you have promoted the program with the use of spam/unsolicited email.

We will not revoke affiliate status to avoid payment of owed or future commissions. We have no responsibilities with regard to your site. Commission We will pay 25% commission (net of all due taxes) after full payment of any sales contract or order. Payments will be made every 30 days sent in the form of a cheque payable in sterling to the "Payee" as described in the affiliate application form, via snail mail. You are held responsible for your own tax liabilites in relation to this payment. The minimum payment level is £50. Accounts owing under this figure will be carried forward to the next sales period until sales comissions have accumulated to above the £50 threshold. Commissions against sales that are rejected upon credit card authorisation will not be paid, if payment has already been issued we will deduct this amount from your following commission cheque.

Term of the Agreement

The term of this agreement will begin upon our acceptance of your program application and your placement of our banner or textual link on your site and will end when terminated by either party. Either you or we may terminate this agreement at any time, by giving the other party written notice of termination. You can only earn refferal fees on sales occurring during the term. We will never withold any payment due. Modification We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a new agreement on our site. Any modifications will also be notified by email to all participating affiliates. If any modification is unacceptable to you, you may terminate this agreement. Your continued participation in the program following notification of our new program will constitute binding acceptance of the change. Relationship of Parties You and we are independent contractors, and nothing in this Agreement will create any partnerhip, joint venture, agency, franchise, sales representative or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything written here.
